1.1 This Application Form, along with the Standard Terms and Conditions, constitutes the contract on a license basis between Quickstayz Rentals Private Limited and the Resident. As per this contract, Quickstayz Rentals Private Limited agrees to provide long-term residential accommodation services to the Resident at the Facility for the Contract Period, and the Resident agrees to adhere to the terms mentioned hereunder.
1.2 The Facility Address is mentioned in Schedule I attached herewith.
2.1. Admission to the Facility is provisional and contingent upon payment of the Facility Charges as stated in the admission form.
2.2. Accommodation services at the Facility are offered on a ‘First-Come-First-Serve’ and ‘Subject to Availability’ basis, and Quickstayz Rentals Private Limited reserves the RIGHT OF ADMISSION.
2.3. A seat at the Facility is not guaranteed until the Resident has completed all enrollment requirements on or before the Cut-Off Date specified in the Enrollment Form.
2.4. Facility Charges: Residents must pay the facility fee in accordance with the admission form, along with any interest-free refundable deposit, in advance at the time of admission. All residents must make rent payments on the specified due date. Failure to do so will result in the management determining the continuation of the tenancy.
Please ensure that rental payments are made only to the company’s official account.
- Payments will not be accepted in any personal account.
- Cash or cheque payments are strictly prohibited.
Ensure that all transactions are processed directly through the official company account to prevent any complications.
The company holds no responsibility for any payments made to accounts other than the official company account.
2.5. Refundable Security Deposit: An interest-free Refundable Security Deposit will be collected at the time of admission. This deposit may be subject to deductions for any liabilities incurred by the Resident. The deposit is forfeited if the Resident (i) fails to complete all enrollment requirements, including payment of fees and submission of necessary documents, before the Cut-Off Date, or (ii) vacates or abandons the Facility during the term. The refundable Security Deposit will be returned (subject to deductions) at the conclusion of the Contract Period. In cases of eviction due to malpractice or non-payment, the deposit will not be refunded. The refund will be processed within 30 days after the Resident vacates the property.
2.6. Refund Policy: In the event that the Facility becomes inoperable due to regulatory, legal, structural, or other issues, or for any unforeseen reason, Facility Management will refund the Facility Charges for the period the Facility is unavailable. However, no refunds will be granted for the closure of educational institutions due to circumstances such as the COVID-19 outbreak. In such cases, residents are still required to pay rent. Failure to make timely payments will result in the termination of the contract and forfeiture of the security deposit.
3.1. Duration of Stay: The duration of stay is based on the Academic Year of the Resident.
3.2. Room Allotment: Upon payment of Facility Charges, a room will be allotted to the Resident on a leave-and-license basis. Residents are not permitted to swap rooms or move to any vacant room/bed without prior written permission from Facility Management. The Facility Management retains the right to reassign the Resident to a different room during the term.
3.3. No Creation of Tenancy: Occupation of the Facility does not create any tenancy or similar rights. The Resident is granted temporary accommodation subject to compliance with the terms and conditions of this agreement.
3.4. Safety and Personal Belongings: The Facility Management will provide keys to the allotted room. Residents are solely responsible for securing their valuables, which should be kept in the cupboard under lock and key. Residents must not leave valuables such as mobiles, ornaments, and electronics unattended. The Resident is prohibited from changing locks without permission to avoid the risk of lost keys.
3.5. Furniture & Fixtures: The Resident may not bring additional furniture or fixtures into the room. All items provided must be cared for properly. If any items are found damaged or missing due to negligence or misuse, the Resident will be responsible for the replacement cost. Damaged items due to willful harm or misuse will require the Resident to pay for repairs. Furniture and fixtures must not be moved from their designated locations. A penalty may be applied for violations, and any common area damages will be recovered from all Residents in the affected wing or block.
3.6. Electricity Restrictions: Electric appliances are prohibited in rooms. Any unauthorized appliances will be confiscated immediately by the Facility Management. Residents must ensure that lights, geysers, air-conditioners, and fans are switched off when not in use. A fine may be imposed for failing to follow this rule.
3.7. Room Checking: The Facility Management, along with security personnel, reserves the right to inspect rooms and check the belongings of Residents at any time, day or night, in the presence of the Residents.
3.8. Storage of Baggage During Vacation: Residents should secure their belongings in the cupboard with a lock during vacations. A common storage facility may be available for limited quantities of items. Residents must inform the Facility Management about their vacation dates one month before the vacation period. Upon completion of the Contract Period (unless renewed in writing), Residents are required to remove all belongings. Residents may store items if they plan to continue the next term/year.
3.9. Identity Card: Residents must carry their identity cards issued by the Facility at all times when leaving the premises. Security personnel may ask for identity verification, and failure to present an identity card will be reported to the Facility Management for necessary action.
4.1. The Resident affirms that, at the time of signing this Application Form, full disclosure has been made regarding any special abilities or medical conditions requiring attention. This disclosure enables the Facility Management to understand the Resident’s needs and provide the necessary support. Non-disclosure or false information may result in the cancellation of the contract, with any Facility Charges or Security Deposit forfeited.
5.1. Attendance Register: Attendance will be recorded by the Facility Management between 10:00 PM and 10:30 PM every night. Residents are required to personally sign the attendance register or biometric record during these hours (and 11:30 PM on Sundays/Holidays). After this period, Residents are not allowed to leave the Facility without prior approval. Disciplinary action will be taken if this rule is violated without prior permission from the Parent/Guardian.
5.2. Return to Facility: Residents must return to the Facility before the cut-off time as per Schedule I. The Facility gates will be closed at 11:00 PM (11:30 PM on weekends and holidays). In case of late arrival, Residents must sign the late entry register, and the respective Institute, parents, and local guardians will be notified. Repeated late entries may result in cancellation of permission to stay and the return of the fee.
5.3. Celebrations: Residents must seek prior permission from Facility Management for celebrating festivals or birthdays. Celebrations should not exceed one to two hours and should be held in a common area without disturbing other Residents. No external guests or unauthorized interference will be permitted.
5.4. Permission for Night Outs: Night outs are allowed only with written consent from the Facility Management and parents/guardians.
5.5. Visitors: Visitors, including parents and guardians, are allowed only in the common areas. Residents are prohibited from taking visitors to their rooms. Domestic helpers or personal servants are not allowed in the rooms. Parents must provide an undertaking to cooperate with Facility authorities.
5.6. Local Guardian: Residents must provide details of their local guardian, authenticated by their parents, and ensure that the local guardian signs the Facility rules.
5.7. Medical Treatment: Residents with medical insurance must share policy details with the Facility. The Facility offers first aid to residents, and any medical emergency will result in the Resident being referred to a hospital. All associated costs will be borne by the guardian.
6.1. Inspection: Facility Management will decide the menu and periodically inspect the food quality. Feedback will be provided for improvement.
6.2. Food Serving: Food will be served in the Facility mess at designated times. Residents are prohibited from taking food outside or using mess utensils in their rooms. Violations will incur penalties.
6.3. Food Wastage: Only authorized members can dine in the mess. Residents must inform the Mess Supervisor if they plan to dine out or be absent to prevent food wastage.
6.4. Sick Diet: Residents requiring a special diet due to illness can request Facility Management for suitable food arrangements.
6.5. Guests: Guests are not allowed in the mess unless prior permission is obtained from Facility Management and a fee is paid.
8.1.1. Residents should promptly inform Facility Management of any necessary maintenance (civil, carpentry, electrical) in their rooms.
8.1.2. Residents must cooperate with maintenance work and vacate rooms when required. The Facility Management will provide alternative accommodation if needed.
8.2. Reporting Undesirable Activities: Residents must report any undesirable incidents or activities observed in the Facility to Facility Management.
9.1. Ragging: Ragging in any form is strictly prohibited and is a punishable offense under law, leading to expulsion from the Facility.
9.2. Alcohol/Drugs/Smoking: Consumption, possession, or storage of alcohol, drugs, or tobacco products is prohibited in the Facility, including by visitors.
9.3. Gambling: Any form of gambling is prohibited in the Facility. Violators will be expelled, and legal action will be taken.
9.4. Misuse of Internet and Social Media: Residents are prohibited from uploading offensive content online or misusing the internet in any form.
9.5. Political or Communal Activities: Engaging in political or communal activities that disrupt law and order or violate government policies is prohibited.
9.6. Media Interaction: Residents must obtain written permission from Facility Management before speaking to any media personnel.
9.7. Assault: Physical assault within the Facility is prohibited and will result in disciplinary action.
9.8. Firearms: Possession of firearms, explosives, or flammable materials is strictly prohibited.
9.9. Pets: Residents are prohibited from bringing or keeping pets in the Facility, including stray animals.
10.1. Disciplinary Actions. In addition to any penalties, fines, or punishments outlined in these Rules, disciplinary actions will be taken against any Resident violating these Facility Rules and Regulations as per the Facility’s guidelines.
10.2. Recovery of Damage/Losses to Property. If any communal property is lost, damaged, or disfigured, the costs will be equally shared and recovered from the Residents responsible for the damage or loss. If the responsible Resident(s) cannot be identified, a collective fine will be imposed by Facility Management to recover the loss.
10.3. Expulsion from Facility. The Facility Management reserves the right to expel any Resident for willful disobedience, defiance of authority, violation of facility rules, causing damage to people or property, or involvement in any antisocial or illegal activities. In such cases, the deposit will be forfeited, and the Facility fee will NOT be refunded. Residents who are expelled from their respective institutions will also be expelled from the Facility, and the Facility fee will not be refunded.
11.1. Nothing in this clause shall limit or exclude the Facility’s liability for death or personal injury resulting from the negligence of the Facility or its employees, directors, agents, or subcontractors.
11.2. Subject to the above clause, neither party shall be liable under this Agreement (whether in contract, tort, or otherwise) for any special, indirect, or consequential losses, regardless of whether such losses were within the contemplation of the parties at the time of this Agreement.
11.3. The total liability of the Facility, regardless of the legal basis (contract, tort, etc.), will not exceed the Facility Charges collected from the Resident.
12.1. The Facility shall not be liable for any events or circumstances beyond its reasonable control, including acts of God, natural calamities, storms, earthquakes, or other similar unavoidable causes (“Force Majeure” events). The Facility will not be held responsible for defaults caused by such events.
12.2. If the Force Majeure event continues for more than 30 days, the Facility has the right to terminate the Agreement by providing written notice and refunding the Facility Charges, including the Security Deposit, for the unexpired term. Please note that this clause does not apply in case of a shutdown due to COVID-19.
13.1. Suggestions and complaints may be submitted either in the Suggestion Box or recorded in the Suggestion Register available at the Facility. Suggestion forms are also provided within the Facility for this purpose.
14.1. This Agreement shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions, and the courts of the National Capital Territory of Delhi shall have exclusive jurisdiction.
14.2. Any dispute, controversy, or claim arising out of or relating to this Agreement, or its breach, termination, or invalidity, must be resolved by arbitration within thirty (30) days of the failure of negotiations.
14.3. The arbitration shall take place in Delhi and will be conducted in accordance with the Arbitration and Conciliation Act, 1996, by a single arbitrator. The arbitration proceedings will be conducted in English, and the arbitration award will be final and binding on both Parties.
I/We confirm that we have read and understood the terms and conditions and acknowledge that the Resident’s admission to the Facility is based on the acceptance of these terms.
Please note that the minimum stay duration is 12 months. If the Resident shortens the stay duration to less than 12 months, the entire security deposit will be forfeited.
